National Interest Waiver
The National Interest Waiver allows some individuals to apply for permanent residence based upon their occupation without having to go through the cumbersome and lengthy Alien Labor Certification Process.
The National Interest Waiver is available to those individuals who have achieved exceptional ability or an advanced degree in their field. The standard of exceptional ability should not be confused with extraordinary ability. An advanced degree is associated with at least a master's degree in the field of endeavor.
The foreign national must be coming to the U.S. to pursue his field of endeavor which must truly be in the national interest. An individual whose work might help a particular city or region of the country would not qualify. The alien must also be significantly involved in the endeavor. A person who plays only a minor role in a project would not qualify. The foreign national must document a record of past achievement in the field to show that they will serve the U.S. more than other individuals with the same level of education, training or experience.
