Fairfield Divorce Proceedings

With a population of 57, 578 people, many residents of the Town of Fairfield may find themselves confronted with a dissolution of marriage. In Fairfield, and throughout Connecticut, parties seeking a divorce must meet the residency requirement. This means either the party filing, or their spouse, must show they live in the state for at least 12 months before a petition is filed. Alternatively, a party can establish that the grounds for which the divorce is based arose after at least one party moved to the state or was domiciled in Connecticut. In Fairfield County, there are three courts that handle divorce proceedings: Danbury Judicial District, located at 146 White Street in Danbury; Fairfield Judicial District, located at 1061 Main Street in Bridgeport; and Stamford-Norwalk Judicial District, located at 123 Hoyt Street in Stamford. These courts are open Monday through Friday from 9:00 a.m. until 5:00 p.m., with the exclusion of holidays. Spouses can file their petitions in the courthouse where either they or their spouse reside. Often property distribution becomes a factor in divorce proceedings. In Connecticut, all property that either spouse owns is considered marital property and subject to ‘equitable distribution.’ However, this does not mean a clear 50-50 split.
